O presente artigo versa sobre a cegueira deliberada, um instituto que emergiu na Inglaterra em 1861 e se consolidou nos Estados Unidos. Esse instituto visa imputar responsabilidade penal àqueles que se colocam intencionalmente em estado de ignorância para evitar futuras responsabilizações legais. Nessa perspectiva, a ignorância provocada intencionalmente é equiparada à ação consciente. O artigo investiga a evolução histórica e a aplicação da cegueira deliberada no ordenamento jurídico brasileiro, enfatizando sua relação com o sistema jurídico do common law. Como pesquisa qualitativa, de natureza dedutiva e técnica bibliográfica, o artigo expõe um panorama histórico do direito brasileiro e a influência do common law, bem como a Constituição Federal de 1988 e o (re)encontro com o common law. O artigo também analisa a origem histórica da cegueira deliberada nos Estados Unidos e os elementos subjetivos da imputação no sistema jurídico estadunidense, com posterior análise das instruções dadas aos jurados para condenar com base nesse instituto penal. No âmbito jurídico brasileiro, examina-se sua evolução, com posterior análise das dificuldades encontradas para sua aplicação, findando com proposta de medidas para ampliar sua aplicação.
This article deals with willful blindness, a doctrine that emerged in England in 1861 and was consolidated in the United States. This doctrine aims to impose criminal liability on those who intentionally place themselves in a state of ignorance to avoid future legal sanctions. In this perspective, intentional ignorance is equated to conscious action. The article investigates the historical evolution and application of willful blindness in the Brazilian legal system, emphasizing its relation with the common law legal system. As qualitative research, of deductive nature and bibliographic technique, the article presents a historical overview of Brazilian law and the influence of common law, as well as the Federal Constitution of 1988 and the (re)encounter with common law. The article also analyzes the historical origin of willful blindness in the United States and the subjective elements of imputation in the US legal system, with subsequent analysis of the instructions given to jurors to convict based on this criminal doctrine. In the Brazilian legal context, its evolution is examined, with subsequent analysis of the difficulties encountered for its application, ending with proposals for measures to expand its application.
