| dc.description.abstract | O presente trabalho tem por objetivo identificar as mudanças no Código Penal Militar, trazidas pela Lei no 13.491/2017, analisando seus reflexos na Justiça Militar do Estado do Rio Grande do Sul. A pesquisa é orientada pelos seguintes problemas: “quais as principais mudanças trazidas pela nova lei, em relação às Polícias Militares do país? E qual o impacto da referida lei sobre a Justiça Militar do Estado do Rio Grande do Sul?” Parte-se da hipótese que as principais mudanças sejam a alteração dos tipos penais dos crimes militares e o alargamento da competência da Justiça Militar com o aumento da demanda judicial. Concluiu-se que houve a ampliação dos tipos penais considerados como crimes militares. Nos processos judiciais da Justiça Militar, no aspecto material, houve retroatividade apenas em benefício do réu e no aspecto processual a aplicação da lei foi imediata. Quanto à aplicação dos institutos penais não há posição sedimentada. No aspecto quantitativo houve um aumento, ainda que pequeno, de ações penais militares, mas não foi significativo como o esperado. | pt_BR |
| dc.description.abstract | The present work aims to identify the changes in the Military Penal Code, brought by Law no 13.491 / 2017, analyzing its reflexes in the Military Justice of the State of Rio Grande do Sul. The research is guided by the following problems: “what are the main changes brought about? by the new law in relation to the country's military police? And what is the impact of the referred law on the Military Justice of the State of Rio Grande do Sul? ”It is hypothesized that the main changes are the alteration of the criminal types of military crimes and the extension of the jurisdiction of the Military Justice with the increase of the court demand. It was concluded that there was an expansion of criminal types considered as military crimes. In the judicial proceedings of the Military Justice, in the material aspect, there was retroactivity only for the benefit of the defendant and in the procedural aspect the law enforcement was immediate. As for the application of the penal institutes there is no solid position. In the quantitative aspect there was an increase, albeit small, of military criminal actions, but it was not significant as expected. | pt_BR |
